Terms of Service
The agreement between NotifHQ and the customer whose workspace uses it.
Effective 2026-09-16 · All legal documents
Who this agreement is between
These terms are between NotifHQ ("we", "us") and the organisation or individual that creates a workspace ("you", "the customer"). Creating a workspace, calling the API with a workspace key, or sending a message through the service accepts them.
Where you accept these terms on behalf of an organisation, you confirm you are authorised to bind it. In that case "you" means the organisation.
What the service is
NotifHQ is customer-communication infrastructure. You declare contracts, templates and preferences; we render messages from them and carry them over email, in-app, webhook and the other channels the service supports, and we record what happened to each one.
We are a conduit. We do not originate the messages you send, we do not choose their recipients, and we do not review their contents before dispatch. The obligations that follow from that division are set out in the Acceptable Use Policy and the Data Processing Addendum.
Your account and your keys
A workspace key is a bearer credential: anything presented with it is treated as you. You are responsible for keeping keys secret, for rotating a key you believe is exposed, and for the actions taken with a key until it is revoked.
We will never ask you for a key by email or in a support conversation. A message that does is not from us.
What you may send
You may send only messages you are lawfully entitled to send to the recipient in question, and only to recipients who have given you a lawful basis to contact them.
The Acceptable Use Policy forms part of these terms. Sending in breach of it is a breach of this agreement, and we may suspend dispatch for a workspace while we investigate a credible report.
Fees, metering and plans
Plans, their included volumes and their prices are published on notifhq.com. Usage above an included volume is metered and charged at the rate for your plan.
Fees are payable in advance for the period stated on your plan and are not refundable for a period already begun, except where the law requires otherwise or where we have failed to provide the service and have not remedied it.
Availability and change
We aim to keep the service available continuously and will give notice of planned maintenance that we expect to interrupt dispatch. We do not promise uninterrupted availability except where a written service-level commitment says so for your plan.
We may change the service. Where a change removes a capability you rely on or materially reduces what you receive, we will give reasonable notice before it takes effect and you may terminate for that reason without further charge.
Your data
Content you send through the service, and the personal data in it, remain yours. We process them to provide the service, on your instructions, under the Data Processing Addendum.
We do not sell customer data. We do not use the contents of your messages to train models. We do use aggregate, non-identifying operational measurements — volumes, latencies, error rates — to run and improve the service.
Ending the agreement
You may close a workspace at any time. We may terminate for material breach that is not remedied within 14 days of notice, or immediately where continuing would expose us or a third party to legal liability or to an ongoing abuse of the platform.
On termination we stop accepting new messages for the workspace. Data retained under the retention windows for your plan is deleted on the ordinary schedule or sooner on request; see the Privacy Policy.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, neither party is liable for loss of profit, revenue, goodwill or anticipated savings, or for indirect or consequential loss; and our total liability in any twelve-month period is limited to the fees you paid us in that period.
We are not liable for a failure of delivery caused by a recipient's own mail system, by a block list, or by DNS records you control and have not published.
Governing law
This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from it.
Changes to these terms
We may amend these terms. Every version carries the effective date shown at the top of this page. Where an amendment materially reduces your rights we will give notice before it takes effect; continuing to use the service after that date accepts the amended terms.
